Return Policy

Deposits: Except as otherwise provided below with respect to the Restocking Fee, if the Customer cancels the order prior to the time that the Merchant delivers the item(s) to the Customer or informs the Customer that the item(s) is/are available for pick up from the store, any deposit paid by the Customer at the time the order was placed will be fully refunded to the Customer within ten (10) days of the cancellation. The Merchant and the Customer each agree that the terms and conditions set forth herein with respect to deposits override the provisions of Colorado Uniform Commercial Code Section 4-2-718 with respect to liquidated damages, and the Merchant and the Customer both unconditionally waive any rights the Merchant or the Customer may otherwise have thereunder.

Restocking Fee: If an applicable supplier of the Merchant will not allow the Merchant to cancel a special ordered item that is not part of the Merchant’s regular stock of inventory past a certain date (the “Supplier Deadline”), the Merchant may charge a restocking fee of 25% of the sale price (the “Restocking Fee”) if the Customer cancels the order after the Supplier Deadline. The amount of any deposit paid by the Customer at the time of placing the order that exceeds the Restocking Fee, if any, will be fully refunded to the Customer within ten (10) days of the cancellation. The Merchant has sole discretion to determine whether a particular item is or is not part of the Merchant’s regular stock of inventory.

Returns: Merchandise generally may be returned by the Customer to the Merchant within 14 days of delivery to, or pick up by, the Customer; provided, however, that any returned items must still be in “like new” condition at the time of return. The Merchant shall have sole discretion to determine whether a particular item of furniture is in “like new” condition and the Merchant may decline to accept an item for return due to the condition of the item. A cleaning and re-packaging fee may apply as a condition to the Merchant accepting any returned items. The Restocking Fee described above will apply if the returned item(s) was/were special ordered for the Customer and was/were not part of the Merchant’s regular stock of inventory, as determined by the Merchant in the Merchant’s sole discretion.

Deliveries and Pick-Ups: If the Merchant agrees to deliver an item to the Customer’s requested location, a delivery charge shall apply and such delivery charge is non-refundable without exception. If the Customer requests to return an item and the Merchant picks up the item from the Customer’s requested location, a pick-up fee shall apply. Any delivery or pick-up fees shall be determined by the Merchant in its sole discretion. The Customer has the sole obligation to measure the dimensions of each item to ensure delivery can be completed at the requested location and the applicable item fits within the space where the Customer intends to place the item. The delivery fee, and any pick-up fee in connection with an agreed upon return, may include additional fees to the base delivery fee or pick-up fee for special conditions of delivery or pick-up, including but not limited to any special equipment necessary to complete delivery or pick-up, additional personnel needed to accommodate delivery or pick-up, or any delivery or pick-up distance beyond the usual geographic region for the Merchant’s customary practices. The Merchant has sole discretion to determine if special conditions apply and the amount of the applicable additional fee for such special conditions.

Liability for Damages and Non-Conformity: The Customer has the sole obligation to inspect each item upon delivery to the Customer’s requested location, or pick-up at the Merchant’s location, as applicable, and immediately inform the Merchant of any damages to the item or any non-conformity of the item to the specifications for the item at the time of order as reflected in the order receipt (e.g., size, color, material). The Customer agrees that the Merchant is not liable for any damages or non-conformity that the Customer does not inform the Merchant of at the time of delivery or pick up, as applicable, in writing. For the avoidance of doubt, the Customer is liable for any damages to the item that occur after the item has been delivered to the Customer’s location or has been picked up by the Customer at the Merchant’s location, as applicable.
